Conditions of Sale

 

Seller Agreement:

  1.  

  2. This puppy/dog is a 4th generation Australian Labradoodle. This puppy/dog is of typical temperament and structure and embodies the basic standards of the Australian Labradoodle breed.   

       2.The puppy/dog is registered _____X____ registerable ____________ with the WALA.

       3. The registered name is/will be _______________________________________

       4. The kennel prefix ______Sycamore Canyon’s_____ must be used as the first word of the registered name or be used in the name.

       5. WALA registration papers will be filled out after the sale is complete and will be forwarded to the buyer once WALA returns them.    

       6. The purchase price of this puppy/dog will be refunded if the buyer furnishes the seller with a veterinary certificate indicating that the puppy/dog is unwell or unsound and returned within 72 hours from delivery. The Seller will reimburse no veterinary or shipping costs.

       7.  A TWO YEAR WARRANTY is provided to the buyer against any significant and very serious (nature) life-altering GENETIC diseases which occur and/or are diagnosed as certain to occur

within the first two years of the puppy’s life. This diagnosis of genetic disease must be provided to the seller in writing with the necessary ancillary documentation. The seller may elect to require a second opinion at the seller’s cost from a separate and unaffiliated veterinarian subject to reimbursement upon determination of cause as a result of a seller's defect. The buyer herein gives consent to the seller such that the seller may choose to enter into discussions regarding the determination of the veterinarian’s diagnosis with each of the attending veterinarians. Should the dog be found to have a serious life-altering genetic disease, the seller will provide a replacement from a litter within one year of the claim or refund the purchase price of the puppy. The buyer is required to produce all veterinarian records with the microchip and description of the dog clearly marked, and provide them to the seller. If a puppy replacement option is chosen, the buyer understands that the seller may not have a puppy ready for immediate replacement and may have to wait. The buyer and seller will work together to find a suitable replacement puppy from an upcoming litter. If the Buyer cannot agree to the choices of puppies available within one year of the claim, the warranty is void. This warranty does not cover teeth, dental issues, hernias, allergies, or any sequelae resulting from desexing surgeries. 

     8. The puppy/dog is healthy at the time of sale and has had immunizations enumerated in the attached health record.  Should the dog be found to be in poor health of a very serious nature, the seller will provide the buyer with a replacement either from the same litter or another litter, or refund the purchase price, not including shipping; however, the seller retains

the right to select either option as a remedy. The term “serious nature” is defined here and throughout this writing as; any malady which significantly affects the quality of life for the dog and/or imposes an undue financial burden on the buyer and is not the result of buyer neglect, induced trauma, injury, communicable disease beyond the incubation period it could have been exposed at seller’s premises, or accident. 

     9.  If the seller determines, by any means, that the puppy/dog is not suitably cared for, or that it has been mentally or physically mistreated, the seller has the right to take full possession of the dog.

   10.  Records must specify the dog clearly by microchip scan and logging of chip number. Veterinarians must certify the accuracy of the records if required by the seller. 

The parties agree that this contract represents the Full and Final Agreement between the parties and that no other representations, either oral or written have or relied upon for the purposes of this agreement regarding the dog described therein. The parties further agree that no changes in this contract shall be binding upon either of them without written modifications signed by both parties. Both parties agree that the county seat of Riverside County, California shall be the proper jurisdictional venue for this agreement. The parties agree that in the event of legal action that the losing party shall pay reasonable attorney’s fees to the prevailing party whether in whole or in part.

Buyer Agreements 

   

 1. The buyer agrees to maintain the puppy/dog’s health with yearly vaccinations as specified by their veterinarian. Upon execution of this contract, all normative veterinary care and its associated costs are the sole and exclusive responsibility of the buyer. The buyer agrees to maintain this dog in good health, provide routine preventative health care, annual check-ups including but not limited to inoculation, internal and external parasites, and preventative

medicine. Complete veterinarian records must be provided to the breeder for any request involving a refund or replacement. If any of the above preventative care has not been provided the health warrantee will be void.

    2. Should the puppy/dog become ill or unsound, all costs of treatment will be the responsibility of the buyer.    

    3. The buyer agrees to keep the puppy/dog in an appropriate lean weight to maximize the puppy/dog’s soundness and longevity.       

    4. The buyer agrees not to sue the seller and to pay all court or attorney fees incurred by the seller should any suit be brought against the seller regarding this puppy/dog by any person. The buyer signifies acceptance of this condition by initialing here: __________ on ____(date)____.

    5. The buyer acknowledges that special coat care, conditioning, training, and feeding are necessary to produce a healthy Australian Labradoodle and that this care and training is his/her responsibility. 

   6. In the event of the death of the puppy, the buyer agrees to preserve the body until arrangements can be made for an autopsy. In the event of veterinarian recommended euthanasia of the puppy, the buyer agrees to take no action until the seller has approved such action, in any case, the seller again agrees to preserve the body until arrangements can be made for an autopsy. The buyer agrees to provide the seller with a written report with any necessary photographs to substantial any claims of defects. The cost of the autopsy is to be paid by the buyer subject to reimbursement upon determination of cause as a result of a seller's defect. An additional warranty against hereditary orthopedic defects including debilitating hip dysplasia is provided for two years after the date of sale. The guarantee is void should the dog be allowed to become overweight or be involved in any physical trauma that could cause lameness of any type or duration. Should the dog be found to have any orthopedic defects within the first two years, the buyer must provide to the seller proof in the form of X-rays and documentation from the Orthopedic Foundation for Animals located at 2300 Nifong Blvd, Columbia, MO 65201, Telephone number 573.442.0418. The seller reserves the right to have a veterinarian of our choice and at our cost review the results before a replacement or refund are made

7. While all care is taken to determine the coat type, no guarantees can be made regarding the shedding of coat, allergenicity of the coat, and/or type of coat as the puppy matures. 

8. The buyer acknowledges that predictions of size and temperament are only an estimate.

This warranty is null and void if the buyer fails to spay or neuter the dog by 12 months of age, as described in the contract from SpaySecure Pet Services LLC. 

___Initial 

If for any reason, Buyer can the longer take care of this dog, Buyer agrees to give Sycamore Canyon Labradoodles the chance to rehome the dog. The buyer agrees to NOT relinquish the dog to a shelter without contacting the Seller first. 

 Any warranties under this agreement are not transferable and shall apply only to the original buyer.
